Is a Forwarded Email Covered Under CAN-SPAM?

Although not specifically covered in the CAN-SPAM act itself, viral email marketing is an area the Federal Trade Commission has specifically identified for subsequent rulemaking. The FTC has also provided hints in both public and private conversations about how it will rule. FTC officials have indicated that--at the very least--companies that provide an incentive to get their recipients to participate in viral campaigns should consider themselves to be liable under CAN-SPAM.
